Gamigo ban non-gamigo player who playing the Beta?

Liebe Community,

die Teilnahme an dem von Invictus angesetzten Julia Test auf dem ungarischen Server von Invictus bedarf unserer ausdrücklichen Genehmigung.
Die unerlaubte Teilnahme an diesem Test der Betaversion von Julia ist ein Bruch unserer Lizenzrechte und wird mit dem permanenten Bann aus Level R bestraft werden.
Julia ist der Nachfolgepatch von Isabel, welcher in einer extrem frühen Phase ist und wir weigern uns diesen Alphatest (Laut Invictus Betatest) zu unterstützen solange Invictus uns keine releasefähige Isabelversion liefert.

Dear community,

to participate on the Julia Beta test on the server of Invictus our approval is required.
An unapproved participation is a violation of our licenses and results in a permanent ban for Level R.
Julia will be the next Level R version after Isabel version. Because the Julia version is early alpha it has not entered our test yet nor do we support any Julia tests before an Isabel release.

I can understand if the statement means that Gamigo can give purnishment of permanent ban from their beta against the player who have no authorization of participation of the beta by gamigo ? It means just Gamigo have right to kick out (=ban) unauthorized player from the Julia beta.

But, it is strange even if some player violates LTCP, how Gamigo can give permanent ban to the player who are not gamigo customer e.g. Aeria customer or Gamepot account holder, or Speed Online drivers??? Maybe Gamigo can have right to ask compensation money against non-authorised players in the Beta. But, it is not Gamigo matter to ban (means delete) other company's accounts because it is not their customer. It is invictus matter if they give permanent ban or fully repell out the violator from all Level-R series incruding Project Torque, Speed Online, Fastblack and Level-X and Superrace.
